Terms of Service

Please read these terms carefully before using TraceSeek services.

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the websites, services, APIs, applications and other online or offline offerings provided by TraceSeek ("TraceSeek", "we", "us", or "our").

By accessing, browsing, or using the Service in any manner, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. These Terms apply to all users, visitors, and any other persons or entities that access or use the Service.

2. Definitions

Service: The TraceSeek website and any related services, tools, applications, APIs, documentation, and content provided under or in connection with traceseek.com.

Content: Any text, images, audio, video, files, data, messages, logs, metadata, or other information made available through the Service.

User: Any person or entity who accesses or uses the Service.

Personal Data: Any information relating to an identified or identifiable natural person as defined by applicable data protection law (including GDPR).

3. Scope of Services

TraceSeek is an open-source intelligence (OSINT) and analytics platform that indexes, aggregates, and provides search and discovery over publicly accessible information and user-contributed datasets.

The Service may index:

  • Public data breach records and leaked databases
  • Public Discord messages and social media content
  • Publicly posted files and datasets
  • IP geolocation and network information

TraceSeek does not, and will not, knowingly access password-protected accounts, private communications requiring authentication, or private sources without lawful authorization.

4. Registration and Accounts

Certain features of the Service require registration. You agree to provide accurate, complete, and current information when creating an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use or security breach.

TraceSeek reserves the right to refuse registration, restrict access, remove or reclaim usernames, and terminate accounts for any reason, including suspected abuse or violation of these Terms.

5. Acceptable Use Policy

You must use the Service lawfully and in good faith. Prohibited activities include but are not limited to:

  • Harassing, stalking, targeting, doxxing, threatening or facilitating harm to individuals
  • Uploading or distributing content that is illegal, exploitative, or abusive
  • Using the Service to facilitate or commit criminal activity, fraud, or extortion
  • Attempting to access private or unauthorized data sources by bypassing authentication
  • Employing automated scraping beyond permitted API limits or reverse engineering the Service
  • Interfering with, impairing, or disrupting the Service or servers

TraceSeek may suspend or terminate accounts and block IPs engaging in prohibited conduct and may retain evidence for reporting to law enforcement.

6. User-Generated Content and Licensing

Users retain ownership of the content they upload or submit, subject to the licenses granted herein.

By uploading, posting, or submitting Content to the Service, you grant TraceSeek a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such Content for the operation, improvement, promotion, and provision of the Service.

TraceSeek may remove, edit, or refuse content that violates these Terms or that the Service, in its discretion, deems objectionable.

7. Intellectual Property Rights

All intellectual property rights in the Service (including software, designs, logos, trademarks, text and other content owned by TraceSeek) are owned by or licensed to TraceSeek.

You may not copy, reproduce, display, distribute, or create derivative works of TraceSeek's proprietary content except as expressly permitted by these Terms or with our prior written consent.

Third-party content remains the intellectual property of the respective owners. TraceSeek does not claim ownership of third-party materials indexed by the Service.

8. Payments, Refunds and Billing

Payments for premium features or subscriptions are processed using cryptocurrency payment providers. By purchasing, you agree to their terms as well as ours.

All prices are in USD and exclude local taxes unless stated. Fees are non-refundable except as required by law.

TraceSeek reserves the right to change pricing; changes affecting active subscriptions will follow reasonable notice and applicable consumer protection laws.

9. Disclaimers and Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. TraceSeek expressly disclaims any implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

TraceSeek does not warrant that the Service will be uninterrupted, error-free, or completely secure. The Service's indexing of third-party content does not mean the content is accurate, lawful, or endorsed by TraceSeek.

10. Limitation of Liability

To the maximum extent permitted by law, TraceSeek and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or in connection with these Terms or your use of the Service.

Where local law requires certain warranties or prohibits exclusion of certain liabilities, those local requirements apply and this limitation will be adjusted accordingly.

11. Termination

TraceSeek may terminate or suspend access to all or part of the Service for any reason, including violations of these Terms, suspected illegal activity, or upon request by law enforcement or pursuant to a valid court order.

Termination may be immediate and without prior notice. TraceSeek will attempt to inform account holders if reasonably practicable, except where prohibited by law or where notice would compromise an investigation.

12. Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to these Terms shall be governed by and construed in accordance with the laws of your local jurisdiction, without regard to conflicts of law principles.

Except where otherwise required by applicable consumer protection law, you and TraceSeek agree to submit to the jurisdiction of the courts for any dispute arising out of or relating to these Terms.

13. Changes to Terms

TraceSeek may revise these Terms at any time. Changes will be posted to the Service with the date of last revision and will take effect upon posting or as otherwise stated.

Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service.
